According to Tom, only a small percentage of claims end up going to court; the remaining majority are successfully settled before that point. Even among cases that do go to court, many of them end up being settled before the actual trial process starts. (A case can settle at any time, as long as both sides agree to the settlement terms.) Of course, there are certain cases that simply have to go to trial.
