Car accidents are always scary. And if youā€™re 38 weeks pregnant, the stress, confusion, and anxiety can be overwhelming.

When a negligent driver hurt Molly and put the health of her unborn daughter at risk, she and her husband reached out to Crosley Law for help. We went to work right away to ease her stress, simplify the process, and get her family the fair compensation they deserved as quickly as possible.

Driver Inattention Leads to a High-Speed Collision

At about 9:30 in the morning, on a clear day, Molly was traveling south on E Loop 1604 N in rural eastern Bexar County.

As she approached an intersection, the driver of a Chevy Equinox failed to check for traffic at a blinking red light and entered the same intersection, heading west. Molly had no time to avoid the collision and was T-boned by the other driver. The front driver side of Mollyā€™s Land Rover was severely damaged, while the Equinox turned over on its side and came to rest against a utility pole.

Due to her pregnancy, Molly was transported to the hospital immediately after giving a statement to police.

The responding officer was unable to speak to the driver of the Equinox at the scene. In his report, he described her as ā€œincoherent and confusedā€ as a result of the crash. She was also transported to the hospital.

Molly Suffers Severe Injuriesā€”and Fears for Her Daughter

After the crash, Molly experienced headaches, a few broken toes, as well as pain and bruising in her neck, upper back, lower back, and stomach. Diagnostic imaging revealed a herniated disc in her neck and two more in her lower back, in addition to several other ligament sprains throughout the spine and disc displacements in her neck. Her doctors prescribed steroid injection therapy to help her manage the discomfort.

Of course, in the immediate aftermath of the crash, Mollyā€™s greatest fear was for the health and safety of her unborn child. Due to the wreck, Mollyā€™s doctors were forced to induce labor earlier than anticipated. Happily, her daughter was born healthy and with no apparent ill effects from the crash.

But while greater tragedy was averted, it was still an emotionally traumatic experience for Molly and her husband. Molly also continued to experience chronic pain from her other injuries.

Crosley Law Secures Full Policy Limits Settlements from Two Insurance Carriers

Dealing with chronic pain and injuries after a car accident is hard enough even without a newborn baby in the picture. Molly and her husband knew they needed help, so they contacted Crosley Law. The Crosley team worked quickly to gather evidence, including the police report, medical records, and eyewitness statements and photos.

The other driver was carrying only $50,000 in injury liability coverage. That wouldnā€™t even cover Mollyā€™s total past and future medical bills, let alone provide any compensation for the emotional trauma she experienced or her ongoing physical pain and limitations.

Fortunately, Molly was also carrying underinsured motorist (UIM) coverage in her own auto insurance policy, which is designed to kick in when an at-fault driver doesnā€™t have enough coverage. (Situations like Mollyā€™s are extremely common, which is why we always strongly encourage everyone to purchase uninsured and underinsured motorist coverage.)

The facts were strongly on Mollyā€™s side, and Crosley Lawā€™s fast and thorough investigation paid off. Within five months of the crash, we were able to convince the at-fault driverā€™s insurance company to offer Molly the maximum $50,000 settlement. Just two months later, we were able to secure the maximum policy limits settlement from Mollyā€™s own UIM coverage as well. We never even had to file a lawsuit against either insurance company.

The Crosley team made our traumatic event much less taxing by being by our side the entire aftermath. Not only were they professional and on top of everything, but they also made my husband and I feel so important and taken care of.
