Hit By an Uninsured Driver: Crosley Client Receives Maximum Settlement

In 2014, Becky S. was leaving work on a Friday afternoon and looking forward to the weekend. Minutes after she started her journey home, she was completely stopped at a red light and felt an unexpected, severe impact to the rear of her vehicle. The other driver was not paying attention, did not attempt to brake, and was uninsured. Becky’s situation was further complicated because she was driving her boss’s car, not her own.

Becky Suffers Serious Injuries to Her Back, Neck, and Shoulder

A few days later, Becky realized how sore she felt and how much pain she was in. She was experiencing debilitating back, neck, and shoulder pain. She tried several conservative treatment options, including epidural steroid injections, chiropractic care, and physical therapy, but none of them resulted in reliable, lasting relief.

After trying to treat her symptoms non-invasively with little success, Becky saw an orthopedic surgeon who suggested a series of operations to help alleviate her pain. Becky endured two surgeries. The first was a lower lumbar fusion for her back pain in September 2014. The second was an anterior cervical discectomy and fusion to correct her neck and shoulder pain in December 2015. During these procedures, Becky’s doctors removed damaged parts of her spine and inserted hardware to help stabilize it.

The accident, surgeries, and subsequent treatments left Becky with thousands of dollars in lost wages, more than $150,000 in medical bills, and ongoing medical expenses for physical therapy, chiropractic care, and pain medication. Becky, who happens to be a paralegal, was referred to Crosley Law by her boss. The law firm Becky works for routinely sends personal injury cases to Crosley Law because of Tom Crosley’s specialty in and success with personal injury cases. He is board certified in personal injury trial law, and his practice focuses exclusively on personal injury and wrongful death cases.

“We’ve been satisfied with every case we’ve sent to Mr. Crosley,” said Becky. And she was about to find out why from personal experience.

Crosley Law Addresses Her Complex Legal Issues and Gets Results

Becky’s case had a lot of “interesting legal wrinkles,” explained Tom Crosley. She was hit by an uninsured driver while she was driving a car she didn’t own. Because the car was owned by her boss and Becky used it often, the insurance company took the position that Becky’s claim was not covered based on a technical reading of the exclusions in the insurance policy.

“The accident caused a lot of expense and disruption of Becky’s life. It was very important for us to identify other insurance policies that would cover her claim,” said Tom. On top of the car owner’s insurance, Becky also had personal insurance.

Although Becky works for a law firm and has a lot of her own experience in the legal field, she learned exactly how beneficial retaining an attorney for personal injuries can be. Her experience with Crosley Law went very well, and she was happy with their process and outcome of her case. When Becky had questions, she simply picked up the phone or sent an email, and Priscilla (a legal assistant at Crosley Law) would respond promptly.

“She is absolutely the best at responding of any person in the legal field that I’ve ever seen,” Becky raved. “You can’t ask for more than that.”

“Working with Crosley Law was a smooth experience,” she said. “I never had to call to see how my case was going. I know a lot of people who had bad experiences with law offices they have retained. They don’t know if anything is happening to their case. I never had to wonder.”

After Becky’s treatments were completed and she was back on her feet, the work of building her case began in earnest. After having an in-depth meeting about Becky, the accident, her injuries, subsequent treatments, and ongoing medical complications, a letter of demand was sent to the insurance companies. Both insurance companies responded to the letter of demand with a lower offer than what was fair in light of Becky’s needs.

“Mr. Crosley spoke with the insurance adjuster and explained that I had had surgery on two different places on my body,” she said. “And with the recuperation period, he felt the claim was worth the maximum amount.”

Crosley Law put pressure on the insurance companies to fight for Becky to get the compensation she needed.

“In the end, we were able to convince both insurance companies that they were legally obligated to cover Becky’s claims, and get maximum settlements on her behalf,” said Tom. The total of all settlements was $380,000. Quite a difference from when Becky first hired Crosley Law after the insurance company initially denied her claim!

Crosley Law: Satisfied Clients

“By the end of most cases, and Becky’s is no exception, we feel like these are members of our family. We develop good, lasting relationships with our clients,” explained Tom.

“I never felt that [Crosley Law] was in it for the money. It was all about me,” said Becky. “Everyone I have met here is very nice. You really do feel like you’re part of the family. They look after you.”

“It’s important to me that our law firm treat every client as if their case is our most important case,” Tom commented. “I want to make sure we can deliver that level of service to everyone.”
