Proving “Invisible” Injuries After a Catastrophic Truck Crash: Joshua’s Story

Share on social:

Joshua was a passenger in a work truck. His work crew had just finished dropping off some oil field equipment. As they were driving down the highway, an 18-wheeler ran a stop sign and violently struck Joshua’s vehicle.

The force of the collision mangled both vehicles. Everyone in the pickup was seriously injured and the semi’s driver was ejected from his cab. He died shortly after the truck crash. Joshua was rushed to the hospital due to head, chest, and leg pain and difficulty breathing.

Joshua Suffers Multiple Injuries, Including Brain Trauma

Unlike many of the other people in the pickup, Joshua didn’t need emergency surgery. However, he still suffered severe injuries. At the hospital, he was diagnosed with:

  • Bruising (hematoma) in his brain and head
  • Multiple rib fractures and a collapsed lung
  • A severe spleen laceration
  • A severe leg contusion
  • Reversal of the curvature of his neck (a sign of trauma)

During his three days in the hospital, the doctors focused on his obvious, physical injuries. While Joshua couldn’t remember much about the crash, there was little discussion of brain trauma at the time. However, during follow-up appointments with his doctor, Joshua was diagnosed with a concussion.

Even though Joshua didn’t require immediate surgery after the truck wreck, he needed extensive medical treatment and rehabilitation, including repeat MRI studies and therapy for his leg and brain injuries. Unsure what to do, his family turned to Crosley Law for help.

Multiple Accident Victims Fight the Insurance Company (and Each Other) for Compensation

While it was clear that the 18-wheeler’s driver caused the truck wreck, other issues complicated Joshua’s case. Everyone who was involved in the crash suffered significant injuries and deserved compensation. This meant that the insurance company had to divvy up the trucking company’s liability and excess insurance policies. Everyone assumed that the victims’ claims would quickly exceed the policy limits, and some of the other attorneys argued Joshua didn’t deserve as much compensation as the others.

However, our client was young and had been in good health before his accident. The father of three young children, he was a loving husband and an active father who enjoyed playing softball. Now, he had a serious leg injury, memory problems, mood swings, and sometimes struggled to communicate his thoughts. His relationship with his family was forever changed and he had a hard time doing the things he loved.

Tom Crosley notes, “While (Joshua) did not sustain an injury that required immediate surgery, it didn’t mean that his claim was worth any less. A TBI is a permanent injury… We had to put all the pieces of the puzzle together.”

Crosley Law Uses Expert Witnesses and Advanced Technology to Prove Joshua’s Claim

First, Joshua was reporting symptoms that were consistent with a severe traumatic brain injury. However, he was having problems accessing the care he needed. The Crosley Law team stepped in, working with numerous brain injury experts, including a neuropsychologist and two neuroscientists.

Then, we secured advanced imaging studies for Joshua. Compared to a typical MRI, these studies more clearly pinpoint brain trauma. Joshua’s advanced MRI showed clear brain trauma, including the shearing of blood vessels and nerves.

Next, we took all of this medical evidence, and began calculating Joshua’s damages. Our team consulted with even more experts:

  • Vocational consultants who assessed Joshua’s ability to work within his limitations
  • Life planners who helped us understand Joshua’s future needs
  • Economists who calculated his financial losses and their present value

Based on the objective evidence, it was clear that Joshua’s life would never be the same.
