A Pickup Truck Hits Carl’s Bicycle — With Life-Altering Results

Carl was pedaling his bicycle along Broadway Street in San Antonio. He had just reached an intersection when a Ford F-350 pickup suddenly pulled out and smashed into him. Carl suffered catastrophic injuries, and emergency responders immediately rushed him to the hospital.

During the police investigation of the crash, the truck driver claimed that he did not see Carl’s bicycle until seconds before the collision. The police cited the driver for distracted driving and failing to yield the right of way.

However, a witness said they had seen Carl’s bicycle shortly before the crash and did not observe an operating headlight on the bike. As a result, the police report listed “failure to use a headlight” as a factor that may have contributed to the crash.

Unfortunately, because Carl had suffered such severe injuries, the police could not interview him and get his side of the story after the crash.

Carl Requires Emergency Surgery for His Injuries

When Carl arrived at the hospital, the physicians diagnosed him with multiple severe injuries, some of which required emergency surgery. Those injuries included:

  • Traumatic brain injury
  • Broken leg bones (tibia and fibula) with nerve damage
  • Bowel perforation
  • Bruised and collapsed lung with blood in the chest cavity (hemopneumothorax)
  • Multiple broken ribs
  • Broken nose
  • Fractured breastbone (sternum)
  • Pelvic bone fractures
  • Spine fractures
  • Facial lacerations

To treat Carl’s leg injuries, doctors had to implant hardware and screws to stabilize his leg. Carl also underwent emergency abdominal surgery and needed a drain tube inserted in his chest.

Even after Carl’s medical condition stabilized, he still required additional care. Carl struggled with chronic pain and needed intensive physical therapy. To this day, he has difficulty walking. His brain injury also caused fatigue, depression, concentration problems, and short-term memory loss, among other issues.

Crosley Law Helps Carl Get the Compensation He Deserves

The insurance company for the driver that hit Carl initially denied the claim, taking the position that Carl was at fault for the crash. Even though there was no disputing that the truck crash caused Carl’s serious injuries, the insurance company tried to shift the blame to Carl by arguing that his failure to use a headlight caused the crash. Carl maintained that his headlight was on and working properly at the time of the wreck.
