Video: Should I Accept the Insurance Company’s Settlement?

An insurance company has made you a settlement offer for your personal injury claim. Should you accept? In this video, Attorney Tom Crosley of Crosley Law Firm explains what factors you need to consider if you find yourself in this situation.

Crosley offers two different scenarios for considering a settlement and explains how you should proceed in each situation:

  • If you don’t have an attorney, you should consider whether you have ongoing medical problems and need further medical care. If you’re still receiving medical care, Crosley says, it’s too soon to settle your case because you may incur future medical costs that you can’t yet anticipate.
  • If you do have an attorney, you should meet with your attorney and go over the pros and cons of the settlement as well as what will happen next if you decline.

Crosley also says that, as a general rule, people with only minor injuries can accept a settlement offer if the following conditions are met:

  • They’re completely well
  • The settlement covers all of their medical costs
  • There aren’t any outstanding hospital liens or health insurance claims related to their injury

Any other time, it’s best to consult with an experienced personal injury attorney about what your best course of action is.
